- Use the mark in commerce or file an “Intent to Use.”
- Put the mark on your product how it will be seen by the public and show how it functions as your mark.

- Apply for trademark registration.
- Your application may be accepted or it may be objected to, in which case you will receive an Office action.
- If your application is objected to, then the applicant response to the Office action and addresses issues raised by the examiner within six months of the objection.
- If your trademark is approved, your mark will be published for opposition, where a party may oppose the issuing of the trademark.
- If there is an opposition, you or an attorney will argue to the examiner why your trademark should be allowed.
- If there is no opposition or you successfully argue that your mark is allowable, you will receive either a Certificate of Registration or a Notice of Allowance.
